  1. The Department of Education has adopted the Department of Budget and Management (DBM) and Department of Health (DOH), Joint Circular No. 1, s. 2016 dated July 15, 2016 entitled Amendment to DBM-DOH Joint Circular No. 1, s. 2012 regarding the Rules and Regulations on the Grant of Compensation-Related Magna Carta Benefits to Public Health Workers (PHWs). Particular attention should be given to Section 3 (New Rules on Hazard Pay) and Section 4 (New Rules on Salary Step Increment for a Post Graduate Degree).
  2. The Supreme Court (SC) in the case of Gil G. Gawad, et. al. vs. Florentino B. Abad, et. al. G.R. No. 207145, declared invalid Item 7.2 of the DBM-DOH Joint Circular No. 1, s. 2012.
  3. All regional directors and schools division superintendents and other concerned officials are directed to grant benefits and other incentives to all DepEd health personnel based on Magna Carta for PHW as per Republic Act No. 7305, following the SC decision and DBM-DOH Joint Circular 1, s. 2016.
  4. All other issuances inconsistent with this Order are rescinded.
  5. Immediate dissemination of and strict compliance with this Order is directed.
